Legal Perspectives on Israel’s Legal Rights to Rescind Parts of Its 2005 Disengagement Law - Amb. Alan Baker, Lenny Ben-David

The new legislation would enable the return of the residents to their homes and properties after the implementation of requisite legal and security arrangements and the resolution of land ownership claims by Palestinians.

Vol. 23, No. 4

In a press briefing on March 21, 2023, State Department Principle Deputy Spokesperson Vedant Patel expressed U.S. concern at new Israeli legislation rescinding parts of a 2005 disengagement law. 1 Similar concerns were voiced by Deputy Secretary of State Wendy Sherman to Israel’s ambassador Michael Herzog2 as well as by former U.S. Ambassador to Israel Dan Kurtzer, who described the legislation as “an egregious violation of a commitment to the United States, as well as a reversal of law and policy enacted back in 2005 in the context of the disengagement.”3

The 2005 law, which implemented Israel’s 2004 Disengagement plan, had called inter alia to remove four Israeli settlements – Homesh, Sa-Nur, Ganim, and Kadim – in the northern part of the West Bank area of Samaria, prohibiting further residence there by Israelis.4

The new legislation rescinded this 2005 prohibition on residence in the four localities in northern Samaria on the principal grounds, as set out in the reasoning for the draft law, that it had overlooked the basic property rights of the residents and, as such, was discriminatory, and that it had failed to result in any reduction in Palestinian hostility and terror.

The new legislation would enable the return of the residents to their homes and properties after the implementation of requisite legal and security arrangements and the resolution of land ownership claims by Palestinians. (The sites of Ganim and Kadim are reported to now be part of Jenin’s municipal boundaries in Area A, effectively putting them off-limits to Israelis.)

As expressed by U.S. spokespersons and former Ambassador Kurtzer’s exasperation, the concern appears to interpret this new legislation in an overly broad manner that does not necessarily reflect the actual substance of or reasoning for the legislation.

They wrongly claim that the new legislation would facilitate “creating new settlements, building or legalizing outposts, or allowing the building of any kind on private Palestinian land or deep in the West Bank adjacent to Palestinian communities.” As such, they claim that the legislation contradicts previous undertakings by the Israeli Government to the United States “to evacuate these settlements and outposts in the northern West Bank in order to stabilize the situation and reduce frictions.”

In fact, the 2004 unilateral and independent Israeli plan to evacuate those villages, even after implementation, failed in its stated purpose to secure and encourage a reduction in Palestinian hostility and violence, neither did it stabilize the political and economic situation as hoped.

Israel’s new legislation rescinding the provisions prohibiting residence in the four settlements is distinctly not intended to enable new settlement construction but merely to allow the return of those residents previously removed from their homes and the concomitant restoration of their rights.

No Return to “1949 Armistice Lines”

It is noteworthy to add that the reciprocal U.S.-Israeli commitments of 2004, which served as the premise for the implementation of Israel’s disengagement plan, contained an essential affirmation by President George W. Bush that “it is unrealistic to expect that the outcome of final status negotiations will be a full and complete return to the armistice lines of 1949, and all previous efforts to negotiate a two-state solution have reached the same conclusion.”6

Israeli Prime Minister Ariel Sharon and U.S. President George W. Bush
President George W. Bush and Prime Minister Ariel Sharon, White House press conference, April 14, 2004 (White House archives)

Despite this affirmation, President Barack Obama, in remarks regarding the “Middle East and North Africa” on May 19, 2011, distinctly and egregiously retreated from President Bush’s previous affirmation by stating that “…we believe the borders of Israel and Palestine should be based on the 1967 lines with mutually agreed swaps, so that secure and recognized borders are established for both states.”7

[Note the purposeful use of Bush’s “1949 Armistice line” versus Obama’s “1967 line.” The letter was not drafted by the State Department but by officials in Secretary of Defense Donald Rumsfeld’s office.]

While the 2004 undertakings in the exchange of letters between President Bush and Prime Minister Sharon did not constitute a formal agreement, they nevertheless constituted independent and critical political statements highly relevant in the circumstances prevailing at the time, as confirmed by Bush Administration officials and Sharon’s successor.

According to Elliott Abrams, a senior White House foreign policy official in Bush’s National Security Council, Sharon and American officials agreed to four principles articulated by Sharon himself in a December 2003 speech: “Israel will meet all its obligations with regard to construction in the settlements. There will be no construction beyond the existing construction line, no expropriation of land for construction, no special economic incentives, and no construction of new settlements.”8

President Obama’s retreat from the U.S. commitment regarding borders significantly altered the basic premises that lay at the foundation of the exchange of letters and Sharon’s rationale for withdrawal from Gaza and northern Samaria.

In light of the 2011 retreat by President Obama from President Bush’s 2004 affirmation regarding the permanent status borders, the concern and exasperation voiced by U.S. Administration spokespersons, and especially by Dan Kurtzer, that Israel’s latest legislation contradicts previous undertakings, would appear to be misplaced, especially taking into consideration the altered circumstances of the current, super-charged Palestinian violence and terror activity and the other external threats against Israel.

Trump hush-money grand jury proceedings 'canceled' for Wednesday, sources say - Brooke Singman , Marta Dhanis , Chris Pandolfo

by Brooke Singman , Marta Dhanis , Chris Pandolfo

--------

Manhattan District Attorney Alvin Bragg's office has "canceled" the grand jury meeting that was scheduled to take place Wednesday as part of the investigation into former President Donald Trump, amid speculation of a possible indictment, two sources familiar told Fox News.

The grand jury was slated to meet Wednesday and was expected to hear from at least one additional witness, but Fox News has learned that Bragg's office "canceled" the proceedings.

Former President Donald Trump may be indicted by the Manhattan District Attorney's office on charges related to the Stormy Daniels scandal.

The grand jury was notified Wednesday morning and was placed "on standby" for Thursday, a source told Fox News.

"We can’t confirm or comment on Grand Jury matters," Bragg's office told Fox News.

Two sources familiar told Fox News Digital on Wednesday that the grand jury was canceled amid "major dissension" within the district attorney's office. One source claimed the district attorney is having trouble convincing the grand jury on potential charges due to the "weakness" of the case.

Despite rumors of a potential imminent indictment, sources familiar told Fox News Digital that Trump has not been formally notified about whether Bragg actually plans to bring charges against him.

Sources told Fox News, though, that there remains a real chance that Bragg does not choose to indict the former president.

Bragg, when he took over as district attorney in January 2022, stopped pursuing charges against Trump and suspended the investigation "indefinitely," according to one of the top prosecutors who resigned from the office in protest.

Prosecutors Mark Pomerantz and Carey Dunne, who had been leading the investigation under former DA Cyrus Vance, submitted their resignations after Bragg began raising doubts about pursuing a case against Trump.

The possible charges stem from the $130,000 hush-money payment that then-Trump lawyer Michael Cohen made to adult film star Stormy Daniels, whose legal name is Stephanie Clifford, in the weeks leading up to the 2016 presidential election in exchange for her silence about an alleged sexual encounter with Trump in 2006.

Daniels is not one of the last witnesses that Bragg planned to call. Her lawyer tells Fox News that, as we stand, Daniels has been asked to speak before the grand jury.

"In our conversations [with Bragg's office], there's been no definitive plan to be in New York to testify before the grand jury as it sits," Clark Brewster said.

Federal prosecutors in the U.S. Attorney's Office for the Southern District of New York opted out of charging Trump related to the Daniels payment in 2019, even as Cohen implicated him as part of his plea deal. The Federal Election Commission also tossed its investigation into the matter in 2021.

Cohen has said Trump directed the payments. Cohen paid Daniels $130,000 through his own company and was later reimbursed by Trump's company, which logged the payments as "legal expenses." Karen McDougal, a former Playboy model who allegedly had a relationship with Trump, received a $150,000 payment through the publisher of the supermarket tabloid National Enquirer.

FLASHBACK: TRUMP SAYS HE DID NOT KNOW ABOUT $130K PAYMENT FROM MICHAEL COHEN TO STORMY DANIELS

The Trump Organization "grossed up" Cohen’s reimbursement for Daniels' payment for "tax purposes," according to federal prosecutors who filed the 2018 criminal charges against Cohen for the payments.

Trump has repeatedly denied wrongdoing with regard to the payments made to Daniels, and he has repeatedly said the payments were "not a campaign violation" but rather a "simple private transaction."

Robert Costello, a former legal adviser to Cohen, appeared before the grand jury Monday and testified that Cohen is a "serial liar."

Costello testified before the grand jury for more than two hours on Monday. Costello said he testified that Trump did not know about the payments made by Cohen to Daniels.

The Manhattan DA’s investigation into Trump began in 2019 by then-District Attorney Cyrus Vance. The probe was focused on possible bank, insurance and tax fraud. The case initially involved financial dealings of Trump’s Manhattan properties, including his flagship Fifth Avenue building, Trump Tower, and the valuation of his 213-acre estate Seven Springs in Westchester.

The investigation last year led to tax fraud charges against the Trump Organization and its finance chief, Allen Weisselberg.

Grand jury deliberations and votes are secret proceedings, and an indictment typically remains under seal until an arraignment.

This is a developing story and will be updated.

Netanyahu: Until today my hands were tied on judicial reform dispute - Israel National News

 by Israel National News

Prime Minister delivers address to the nation on the judicial reforms, says the reforms will not be shelved as he seeks a compromise.

Benjamin Netanyahu
Benjamin Netanyahu                                                                                           INN

Prime Minister Benjamin Netanyahu delivered an address to the nation this evening (Thursday) on the government's planned judicial reforms. The address follows Netanyahu's meeting with Defense Minikster Yoav Gallant, who called for the judicial reform bills to be frozen until the next Knesset session.

"Citizens of Israel, a few months ago, as soon as the election results were announced, I said, 'I intend to be the prime minister of all the citizens of Israel,' I meant it then and I mean it today," Netanyahu said at the beginning of his speech. "We have one country and we must do everything to protect it from external threats and from an irreconcilable rift from within. We cannot allow any dispute, no matter how acute, to endanger our shared future."

"The opponents of the reform are not traitors and the supporters of the reform are not fascists. Most of the citizens of Israel love our country and want to preserve our democracy. But since there are those who appropriate democracy for themselves, I want to say a few words about democracy: the supporters of the reform think that there is no democracy here. What is real and what endangers democracy is an all-powerful court. On the other hand, the opponents of the reform think that what will endanger democracy is a Knesset and a government that will act without restraints and without brakes, that will endanger the rights of the individual," he said.

Netanyahu declared "Until today my hands were tied. But no more. Today I enter the conversation, for the sake of the people and the country, I will do everything in my power to reach a solution and calm the spirits in the nation. We are all brothers.''

John Solomon sues DOJ, National Archives over access to declassified Trump-Russia probe memos - Natalia Mittelstadt

 by Natalia Mittelstadt

The suit, brought with help of America First Legal, alleges DOJ is violating the Presidential Records Act by keeping the declassified records from the Archives.

Just the News Editor-in-Chief John Solomon sued the Justice Department and National Archives and Records Administration (NARA) on Tuesday, alleging they have wrongly kept from public inspection hundreds of pages of documents chronicling the FBI's bungled Russia collusion probe that were declassified by former President Donald Trump.

Solomon's suit was filed in U.S. District Court in Washington D.C. with help from the nonprofit America First Legal public interest law firm. It alleged that the two federal agencies were violating the Presidential Records Act by keeping the declassified Russia probe documents out of the Archives' official collection for the Trump presidency.

"This is a case about two government agencies apparently colluding to evade the Presidential Records Act," the lawsuit said, asking the court to "recover the records wrongfully withheld and to force the defendants to comply with the law."

The suit included contemporaneous emails from a top Archives official last August acknowledging that the declassified records should be returned by DOJ "as quickly as possible, so that we can all have a fully releasable set of records."

You can read the full lawsuit here.

NARA told Just the News on Tuesday that it doesn't "comment on litigation matters." The DOJ didn't immediately respond to a request for comment.

Stephen Miller, the president of America First Legal and a former Trump adviser, said a court-ordered return of the declassified records to the Archives was necessary for public transparency and accountability.

"It is hard to identify a more glaring example of the deep state weaponizing government against the American People than unelected bureaucrats refusing to release the records of the Russia collusion hoax after they have been ordered declassified by the duly-elected President of the United States," Miller said. "America First Legal is truly proud to lead the legal battle to restore true democracy and government accountability in America."

After multiple congressional and Justice Department investigations concluded that the FBI engaged in misconduct and mistakes by seeking a Foreign Intelligence Surveillance Court warrant targeting the Trump campaign during the 2016 election, Trump signed an order in his final hours in office in January 2021 declassifying hundreds of pages of previously redacted or secret records.

They included FBI interactions with confidential human sources like former British spy Christopher Steele, whose Hillary Clinton-funded uncorroborated dossier became a centerpiece of the FBI Russia collusion probe and a symbol of its biggest failures. It also included more complete copies of the FISA warrant application and text messages between FBI players in the case.

Though Trump ordered the records released, the full set did not reach the public. Solomon obtained a few of the documents from sources in early 2021 and wrote stories on what they showed, but the complete set was never made public.

Solomon asked for permission in June 2022 from Trump to access his presidential documents at the Archives as a journalist to look for the declassified Russia records. However, when Solomon asked to access the memos from the FBI's "Crossfire Hurricane" investigation, NARA's general counsel explained that the DOJ has held onto them for the past two years to make redactions of some personally identifiable information under the Privacy Act.

The Archives produced to Solomon a memo showing that the morning of Trump's departure from the White House on Jan. 20, 2021, then-White House Chief of Staff Mark Meadows sent the declassified documents back to the FBI for the redactions with an instruction to release them as soon as the deletions were made.

"I am returning the bulk of the binder of declassified documents to the Department of Justice (including all that appear to have a potential to raise privacy concerns) with the instruction that the Department must expeditiously conduct a Privacy Act review under the standards that the Department of Justice would normally apply, redact material appropriately, and release the remaining material with redactions applied," Meadows wrote in the memo.

The records were never released.

Solomon said Tuesday that the Archives told him the DOJ still had not returned the memos. He said he hoped his lawsuit would prompt the public release of all the documents in the near future.

"I sought permission to access these documents nearly a year ago at the Archives as a journalist because these records have significant benefit to the American public," Solomon said. "An American president believed they were important enough to declassify so the public would understand the missteps and failures that occurred during the FBI investigation of Russia collusion.

"They are historical records of a presidency that, as NARA acknowledged to me, belong in the Archives and in the hands of the American public," he added. "I am grateful for America First Legal's help on this matter and look forward to compelling the disclosure of these records for all to see."

The lawsuit comes at a particularly sensitive time for the DOJ and the Archives, as both Trump and current President Joe Biden face criminal investigations after the discovery of classified documents in their possession. One issue in those investigations -- which led to an FBI raid of Trump's Mar-A-Lago estate and consensual searches of multiple Biden properties -- is whether the storage of those documents outside the Archives violated the Presidential Records Act, officials have said.

Solomon's lawsuit chronicles in detail the events that ensued after Trump on Jan. 19, 2021 declassified a binder of hundreds of pages of sensitive FBI documents from the "Crossfire Hurricane" investigation.

On June 19, 2022, Trump designated his former adviser, Kash Patel, and Solomon as his representatives to the NARA to access those records, according to a copy of the letter attached to the lawsuit.

Three days later, Solomon requested that NARA make copies of the declassified documents from the Trump-Russia collusion probe, but NARA said that the DOJ still had them.

Over the following two months, NARA, Solomon, and Patel corresponded over access to the documents.

On Aug. 17, 2022, NARA General Counsel Gary Stern told Solomon that he "asked DOJ to complete its review" of the declassified documents "as quickly as possible, so that we can all have a fully releasable set of records."

"To date, the National Archives has not indicated that the records have been returned," according to the lawsuit.

Federal biosecurity board cut back meetings as US resumed gain-of-function research funding - Greg Piper

 by Greg Piper

Feds twice flagged EcoHealth Alliance research with Wuhan Institute of Virology four years apart but backed off each time. Nonprofit kept getting new grants after belated cutoff.

A federal committee that advises the government on "biological research that has the potential for misuse" met only once between 2017, when a 3-year moratorium on federal funding of gain-of-function (GOF) research was lifted, and 2022, according to its meeting schedule, leaving the panel largely dormant through the worst of the COVID-19 pandemic, widely believed to have been caused by a virus leaked from a Chinese lab conducting U.S.-funded GoF research.

Gain of function research improves the ability of a pathogen to cause disease.

It wasn't just the National Science Advisory Board for Biosecurity that appeared to relax its vigilance against GoF risks, as GoF research funding resumed under the Department of Health and Human Services' so-called P3CO framework for "enhanced potential pandemic pathogens" (ePPP).

(The department claimed at the time that its framework considers "biosafety and biosecurity risks, and appropriate risk mitigation strategies.")

The National Institute of Allergy and Infectious Diseases twice flagged Wuhan Institute of Virology (WIV) research funded by grant recipient EcoHealth Alliance for potential GoF elements, before and after the GoF funding resumption, and twice reversed course, according to an HHS inspector general report in January.

Investigative watchdog group Empower Oversight filed Freedom of Information Act requests with the National Institutes of Health and IG in response to the report.

The open records request seeks "comprehensive communications" regarding the EcoHealth grant and then-NIAID Director Anthony Fauci's discussions with EcoHealth President Peter Daszak in mid-2019, when, under the terms of the grant, the nonprofit should have reported an "enhanced growth" in a WIV-studied coronavirus.

NIH did not request that undelivered 2019 progress report until nearly two years later, the IG found. "This oversight failure is particularly concerning because NIH had previously raised concerns with EcoHealth about the nature of the research being performed," it said.

EcoHealth has previously provided hard evidence that it mentioned WIV's unintentional enhancement of a bat coronavirus in an April 2018 submission to NIH.

Though EcoHealth agreed to cut off WIV at NIH's urging in April 2020 because the Chinese lab may have leaked SARS-CoV-2, the agency nonetheless yanked the nonprofit's award "for convenience" and permitted no appeal, violating NIH's own rules and federal regulations, the IG said.

EcoHealth didn't lack federal funding for long. NIH's grant database shows that in June 2020 the nonprofit received the first of seven new grants totaling nearly $7 million.

Created during the George W. Bush administration and housed in NIH's Office of Science Policy, NSABB met at least twice a year from 2014-2016 before sharply pulling back gatherings for nearly five years, just as EcoHealth was using U.S. taxpayer money for research at WIV that would raise repeated alarms.

NSABB held its first meeting since May 2017, six months before the three-year GoF pause was lifted, on Jan. 23, 2020, in the early stages of the COVID-19 pandemic. It wouldn't meet again until Feb. 28, 2022, followed by two more meetings in less than a year.

The 2020 minutes refer to the emerging pandemic only once and don't mention where it started, either in China or eight miles from WIV, despite board members' acknowledgment that the federal government is "probably" the main U.S. funding source for GoF research.

Also missing: any specific name for the novel coronavirus. The World Health Organization had already dubbed it "2019-nCov," to be replaced by "COVID-19" in February. The meeting agenda is even more disconnected from the prior several weeks of reports from China.

Summarizing a panel discussion on ePPP transparency and security and the lifting of the GoF pause, the minutes emphasize that ePPP does not include "the coronavirus responsible for the current outbreak" because it is "naturally circulating."

Yet Journal of Virology Editor in Chief Rozanne Sandri-Goldin admitted she didn't know the details of "Chinese biosafety review conditions" even though 60% of journal submissions were coming from overseas, mostly China, and some research teams said they meet those Chinese conditions, according to the minutes.

Senate Health Committee Republicans said in an October interim report on COVID origins that WIV was conducting "genetic recombination experiments" at biosafety levels as low as BSL-2, which the U.S. CDC says is for microbes that "pose moderate hazards to laboratorians."

The report cited a September 2019 paper in the Elsevier journal Biosafety and Health by an official at China's own CDC warning that "a comprehensive system of legal and regulatory standards is lacking for BSL-2 laboratories in China."

The Office of Science Policy, which houses NSABB, did not respond to Just the News queries about why it suddenly yanked back meeting frequency after the GoF pause ended and again after the pandemic started.

The HHS IG report shows that NIAID twice accepted EcoHealth's explanations for why its WIV research shouldn't trigger further scrutiny.

EcoHealth's May 2016 progress report suggested to NIAID that the research "could be gain-of-function and subject to the funding pause," but the nonprofit convinced the agency its study of "bat MERS-like CoVs" was "highly unlikely" to have "pathogenic potential."

After the P3CO framework took effect, "NIAID staff internally noted a reference to possible" ePPP in EcoHealth's 2020 grant application and asked for more information. It only took a week for EcoHealth to again convince the agency nothing was amiss, though NIAID approved the award with a condition that it "immediately stop work on all experiments" if any "result[ed] in specific outcomes."

The IG was troubled that NIH couldn't get "scientific documentation" from EcoHealth to "gain insights into the nature of the experiments that were performed" because WIV refused to turn it over.

Empower Oversight, founded by former Senate Judiciary Committee investigator Jason Foster, said this calls into question NIH's claim that "it did not believe that either experiment associated with the enhanced growth is associated with the COVID-19 pandemic."

An intelligence report by satellite and intelligence solutions company ImageSat International (ISI) was able to determine that based on satellite images, an attack in Syria on March 12 included attacks on entrances to underground tunnels. According to intelligence estimates, these tunnels contained the means for the production of surface-to-surface missiles.

The intelligence report also states that the same location has already been attacked several times in the past.

Militia attacks blamed on Israel

In an attack attributed to Israel, two members of pro-Iranian militias were killed and three soldiers from the Syrian army were injured, as reported by Syrian media. The Syrian Observatory for Human Rights reported that the attack was aimed at a weapons depot belonging to the pro-Iranian militias in the Tartus area.

Maariv's military commentator, Tal Lev Ram, elaborated on 103FM, saying "the time is relatively unusual, there was light, you can actually see the signs of the attack."

He continued, "This is an area where several research centers are concentrated, an area that is relatively close to the Lebanese Bekaa [Valley]. There could be an aspect of immediate identification or desire for the message, that you want them to see the attack, it is photographed differently, and it can be an appropriate operational aspect. It shows that the story of Syria is still in the sights as far as the Air Force is concerned."

Torat Lehima: Judicial reform necessary for the IDF - Israel National News

 by Israel National News

Organization says since Aharon Barak's constitutional revolution, the Supreme Court has cost many Israelis lives.

The Torat Lehima organization released a video in which it states that the government's planned judicial reforms are necessary for the IDF to function properly in protecting Israelis from terrorist organizations.

In the video, the organization cited numerous cases in which the Supreme Court has interfered in the operations of the IDF and prevented the military from taking action which could have saved lives, such as demolishing the homes of terrorists who committed massacres.

In particular, the organization noted the court's intervention in preventing the demolition of 20 buildings used by terrorists to shoot at Israeli vehicles on a nearby road in Gaza. Those structures were later used in the murder of Tali Hatuel and her four daughters, ages 2-11, in 2004. Hatuel, who was eight months pregnant, was shot in her stomach to kill her unborn child as well.

"The only way to return the IDF to its glory days is by restraining the Supreme Court and returning the justice system to the people and to those who support the soldiers, not the terrorists," the Torat Lehima organization stated.

Stanford Law Disruptions Were Orchestrated by the National Lawyers Guild - Alan M. Dershowitz

 by Alan M. Dershowitz

The Guild has never abandoned its Marxist-Leninist provenance. It supports Antifa, which also employs violence to disrupt speakers.

  • Let us understand what the National Lawyers Guild is.

  • The Guild, in addition, refused to support Soviet or Cuban dissidents.

  • The Guild has never abandoned its Marxist-Leninist provenance. It supports Antifa, which also employs violence to disrupt speakers.

  • The National Lawyers Guild is not a liberal organization. It does not support civil liberties, due process or freedom of speech. It is the epitome of "free speech for me but not for thee."

  • Many decent people question whether hateful, offensive and even speech deemed "dangerous" by some, should be protected. The answer resides in history. Whenever governments are empowered to ban such expression, they use that power expansively, to censor speech critical of their leaders or partisans. The appetite of the censor is voracious. What are seen as legitimate opinions by dissenters are deemed by others — especially those in power — as hateful, offensive or dangerous. Freedom of speech for all is anything but free. It can be hurtful and risky. But in the end, it is worth the costs.

  • It deplores capitalism and the free market: "don't fund capitalism, fund the groups working to dismantle it." And it opposes due process for those with whom it disagrees, for instance, declaring of a "Mass Defense Program" that sends out "legal workers, law students, and lawyers providing legal support for protests": "We will only show up to actions and in support of movements that directly align with our values."

  • Since its inception, the National Lawyers Guild has relied on "useful idiots" – well-meaning left-wingers and liberals who have no idea what the Guild really represents. It disguises its most extreme positions when presenting itself to the public, but advertises them to its members. It also hides from the public the fact that despite its name, the membership Guild consists primarily of non-lawyers. When it was truly a lawyers' organization, it was slightly more centrist. And then in the 1970s, the Guild opened its membership to "jailhouse lawyers" (who are not lawyers), legal workers (who are not lawyers), law students (who are not yet lawyers) and anyone else who works with or for lawyers or law firms.

  • The Guild has more than 100 chapters in American law schools. Its membership includes many law professors. It apparently plans to organize nationwide disruptions of the kind we have seen at Stanford. The Guild creates the illusion that these disruptions are spontaneous reactions to conservative provocations. They are anything but.

  • As the late Supreme Court Justice Thurgood Marshall observed: "The freedom to speak and the freedom to hear are inseparable; they are two sides of the same coin." These disrupters violated both rights.

  • Thus far disruptions have occurred at Yale, Stanford and Georgetown law schools. But you can be sure that they are coming to a law school near you. The NLG will not be satisfied until no conservative speaker is allowed to speak at any law school. That is its objective, and it may well succeed, because cowardly administrators — especially deans of diversity, in order to avoid the embarrassment of what happened at Stanford, Yale and Georgetown — will try to make sure that conservative speakers are not invited. They understand that it is much harder to object to the less visible non-invitation of conservative speakers than to publicly disrupting them.

  • We who support freedom of speech for all sides must organize as well. We cannot count on the American Civil Liberties Union anymore: its silence supports the censorship of the National Lawyers Guild. Our voices must be heard against censorship-by-disruption, by non-invitation or by any other improper means.

The disruption by several dozen Stanford University law school students of a speech to be given by federal judge Kyle Duncan was organized by the local chapter of National Lawyers Guild as part of a nationwide effort to suppress conservative speech. It turns out that the disruption by several dozen Stanford University law school students of a speech to be given by federal judge Kyle Duncan was not a spontaneous exercise of freedom to protest.

It was a well-planned and carefully orchestrated effort to prevent other Stanford students from hearing the judge's conservative views. The disruption was organized by the local chapter of National Lawyers Guild as part of a nationwide effort to suppress conservative speech. Although not all the participants were associated with the NLG, the main organizers were. The Guild praised "every single person" who participated in the disruption, and called it "Stanford Law School at its best," suggesting it would confront "judicial architects of systems of oppression" with "social consequences for their actions." Here the consequences went beyond "social" to censorial.

Let us understand what the National Lawyers Guild is. Begun in the 1930s as an alternative to the American Bar Association, its original membership consisted of traditional left-wing liberals and communists. After Nazi Germany and the Soviet Union made the notorious Molotov-Ribbentrop Pact in 1939, most of the liberals resigned. Adolf Berle, a prominent "New Dealer," quit because it had become obvious that the Guild "is not prepared to take any stand which conflicts with the Communist Party line."

When Hitler then broke the pact and invaded the Soviet Union, the Guild changed its policy and rejected Hitler. After Japan attacked the United States in 1941, the Guild "remained silent" rather than oppose the internment of more than 100,000 Americans of Japanese descent.

In 1948, the Guild "supported the establishment of the State Israel" because that was the position of the Soviet Union. In 1967, the Soviet Union began to turn against Israel and increased support for the Palestine Liberation Organization (PLO), so did the Guild. Since that time, the Guild has been a strong supporter of Palestinian terrorism and other efforts to destroy Israel.

The Guild, in addition, refused to support Soviet or Cuban dissidents.

The Guild has never abandoned its Marxist-Leninist provenance. It supports Antifa, (see here, here, here and here) which also employs violence to disrupt speakers.

The National Lawyers Guild is not a liberal organization. It does not support civil liberties, due process or freedom of speech. It is the epitome of "free speech for me but not for thee." It will not be swayed by the argument that hateful, dangerous speech should be tolerated at any cost, and defines such speech broadly to include judicial decisions by Judge Duncan.

Many decent people question whether hateful, offensive and even speech deemed "dangerous" by some, should be protected.

The National Lawyers Guild seemingly despises America, and in 2020 passed a resolution declaring:

"The United States government is based on and dedicated to preserving white supremacy, hetero-patriarchy and imperialism... US uses its various government agencies to implement its policies and crush political resistance."

It deplores capitalism and the free market: "don't fund capitalism, fund the groups working to dismantle it." And it opposes due process for those with whom it disagrees, for instance, declaring of a "Mass Defense Program" that sends out "legal workers, law students, and lawyers providing legal support for protests":

"We will only show up to actions and in support of movements that directly align with our values."

This is not to say that all the students who participated in the Stanford disruption agree with these positions. Since its inception, the National Lawyers Guild has relied on "useful idiots" – well-meaning left-wingers and liberals who have no idea what the Guild really represents.

The Guild has more than 100 chapters in American law schools. Its membership includes many law professors. It apparently plans to organize nationwide disruptions of the kind we have seen at Stanford. The Guild creates the illusion that these disruptions are spontaneous reactions to conservative provocations. They are anything but.

Demonstrations and protests are protected by the First Amendment and by the principles of free speech. Preventing speakers from addressing willing listeners is not. Nor is harassing students who invite conservative speakers, as the National Lawyers Guild has done. They violate not only the rights of the speakers they disrupt, but also of those students who came to hear them. As the late Supreme Court Justice Thurgood Marshall observed: "The freedom to speak and the freedom to hear are inseparable; they are two sides of the same coin." These disrupters violated both rights.

Thus far disruptions have occurred at Yale, Stanford and Georgetown law schools.

We who support freedom of speech for all sides must organize as well. We cannot count on the American Civil Liberties Union anymore: its silence supports the censorship of the National Lawyers Guild. Our voices must be heard against censorship-by-disruption, by non-invitation or by any other improper means.

Addendum:

After my criticism of the events at Stanford were written, the Dean of the law school, Jenny Martinez, wrote a lengthy letter announcing that the diversity Dean, who improperly intervened in support of the disrupters, was on leave. The letter, which should be widely read, is an articulate defense of freedom of speech, academic freedom of students to hear controversial views, and university neutrality. She refused to accede to the demands of radical students that she take back her apology to Judge Duncan and she said that student disrupters would be held accountable. She should be commended for her defense of constitutional values.

Netanyahu: Reform opponents not traitors, supporters not fascists - Israel National News

Prime Minister delivers address to the nation on the judicial reforms.

A Terrorist’s Best Friend - Alan Joseph Bauer

 by Alan Joseph Bauer

Who is the greatest supporter of Palestinian terrorism?

A few days ago marked the 21st anniversary of the suicide bombing in which our son, then 7, and I were wounded. There is no greater supporter of Palestinian terrorism than the U.S. government.

At 4:20 pm on March 21st, 2002, a Palestinian policeman detonated himself on King George Street in downtown Jerusalem. The bomber was brought to Jerusalem by two women and sent from Ramallah by an officer in the Palestinian Authority intelligence service. I have written about the bombing and its aftermath previously. A New York jury found the PA and the PLO guilty of the attack and awarded us over $100 million in trebled damages. After multiple appeals, our case goes on today, nearly 20 years after it was filed.

The United States ostensibly fights terrorists throughout the world. Yet, it is the U.S. that is the single greatest contributor to Palestinian terror, more so than Iran, Syria, or other “terror” states. Let’s look at an attack that occurred last week. David Stern, a former US Marine living in the settlement of Itamar, was shot in the head in his car in the Palestinian town of Huwara. Stern returned fire and made his way to a checkpoint before being taken to a hospital. The U.S. ambassador, Tom Nides, duly noted that Stern was a U.S. citizen and, like many others, asked for prayers for his recovery. Nides did not condemn the attack or the attacker. Why would he? Nides and many in Washington see the Palestinians as a wronged people and terror is in their minds a fair tactic for redressing historical wrongs and fighting a “right-wing” government currently running Israel. I wrote to Ambassador Nides last May to tell him that a senior Palestinian minister had been actively involved in our attack. I asked that he and his colleagues refrain from meeting someone involved in the attempted murder of civilians, including two American citizens. Not only did I not receive a response, the same fellow, Hussein al-Sheikh, was allowed into the US and met with Tony Blinken.

And as to Tony Blinken, after we and nine other families won our lawsuit in 2015 in the southern district of Manhattan, the U.S. State Department filed a statement of interest asking the judge to go easy on the appeal bond for the Palestinian Authority. They claimed that too high a bond would end the PA and lead to anarchy. Who signed that statement? None other than under-secretary Tony Blinken. The PA bought Abu Mazen a plane for $55 million the week after the judge agreed to the State Department request to reduce the bond from $700 million to $10 million.

Two weeks ago, a cousin of mine living in Israel called to ask for advice. Having been in a terror attack and having navigated the system, we have become a resource at times for others. This cousin had four young children at a bus stop two months ago when a bomb exploded there. One boy was hit in the head with shrapnel and all four were traumatized by the experience. They refuse to get on a bus to go to school. My cousin said that she had been contacted by the U.S. embassy and by the FBI. I was happy to hear that the red-white-and-blue was proactive in reaching out to her, but I told her not to get her hopes up with respect to the FBI. There have been well over 200 terror attacks in and around Israel in which a U.S. citizen has been killed or injured. The Republican Study Group actually used to keep a running list of such attacks during the Second Intifada. The FBI is legally required to open a file for any American injured or killed in an overseas terror incident. And they do open such files. How many terrorists have been indicted? I know of one. How many have been extradited? Zero?

Obviously the same for prosecution and incarceration. I have spoken to people in the FBI and at the Department of Justice, and they have no shortage of excuses—the Israelis get first dibs, the Israelis don’t share all of the evidence, there is some agreement between Israel and the U.S. not to try the same terrorist on the same charges in different countries, lack of access to the prisoners, and more. All of this might be true, but if the U.S. wanted someone, they would get him or her. The U.S. has more than a handful of levers it can use to get the Israelis to cough up any terrorist desired, but the problem is that there is no desire. The U.S. does not want to prosecute these cases and Israel is more than happy to oblige.

Each year, except for a few during the Trump years, the U.S. sends hundreds of millions of dollars to the Palestinian Authority. Much of this money is used to pay the salaries of Palestinian terrorists in Israeli jails; the guys from our attack have made a fortune while in jail. The Taylor Force Law was supposed to address these payments, but the U.S. government has just ignored it. Even if the monies were reduced, whatever the U.S. sends simply frees up other monies to support terrorists and their families. The U.S. is one of the largest supporters of the Palestinian terror enterprise and this fact has been true for every administration of late—both Republican and Democrat. The monies not taken during the Trump years were the result of a law that would have made the Palestinians agree to be tried in cases like ours in the U.S.: it was the PA that did not want the money, not Trump’s Arabist State Department refusing on principle to send money to the bad guys.

The U.S. talks a good game about fighting global terror. U.S. troops are in multiple hot spots around the globe to fight ISIS, al-Qaeda, and other Islamic terrorist organizations. But for all of the U.S. efforts, the U.S. still is a major provider of funds to the Palestinian Authority, who was found guilty on all counts in a federal courtroom for its role in wounding and killing American victims. Tom Nides can’t condemn Palestinian terror; it would be like someone condemning Google while holding a lot of Google stock. The U.S. continues to endanger Israeli and U.S. citizens by supporting a terror body that glorifies the murder of innocent civilians. Every year we remember the day in which we were injured and thank G-d for our recoveries. We will continue to fight the terrorists in court and in any way we can. I wish that our leaders in Washington could say the same.
