Texas Border Showdown With the Biden Administration - Joseph Klein

The Biden administration’s utter failure to enforce America’s immigration laws is requiring Texas to get tough to protect its own residents from the imminent danger caused by waves of immigrants illegally entering and remaining in the United States.

Rather than work with Texas officials to reverse the record-level influx of illegal immigrants invading the U.S., including suspected terrorists, violent criminals, human traffickers, and drug smugglers, the Biden administration is doing the opposite. The Biden administration is interfering with Texas’s efforts to fix the crisis at its border with Mexico that President Biden has created with policies designed to appease the left-wing open border progressives.

The Biden administration has taken Texas to court over its installation of razor-wire fencing along its border with Mexico. The Biden administration has also filed a lawsuit to invalidate Texas’s recent law, which is not yet in effect, that contains very tough law enforcement measures meant to deter illegal immigrants from crossing into Texas.

Instead of wasting time challenging Texas’s actions to secure the border, the Biden administration should heed the dire warnings by federal law enforcement officials, including FBI Director Christopher Wray, of the imminent danger to national security from President Biden’s open border.

“We are seeing a wide array of very dangerous threats that emanate from the border,” FBI Director Wray testified before a Senate panel on March 11th. He confirmed that “we’ve had dangerous individuals enter the United States of a variety of sorts.” Referring to the heightened terrorist threat in particular, Director Wray told the Senate panel that “there is a particular network where some of the overseas facilitators of the smuggling network have ISIS ties that we’re very concerned about, and that we’ve been spending an enormous amount of effort with our partners to investigate.”

Scary stuff. But President Biden, who regularly warns about supposed threats to democracy coming from domestic extremists whom he equates with Donald Trump and the MAGA Republicans, is silent regarding the “very dangerous threats that emanate from the border.”

During Fiscal Year 2023, which ended last September 30th, the United States Border Patrol apprehended 172 individuals on the terrorist watch list who had crossed the southern border illegally. This total is more than ten times the number of suspected terrorists who were detained by the Border Patrol during the four years of the Trump administration.

Just this month, a self-identified member of Hezbollah, the Iranian-backed terrorist group, was apprehended at the border near El Paso, Texas, after he sneaked across the border illegally. His plan was to travel to New York City and make a bomb. If this terrorist had not for some reason blurted out his plan to Border Patrol agents, he would have been processed and released like the millions of other illegal immigrants since President Biden took office. New Yorkers would have had another dangerous target on their backs.

Who knows how many unvetted potential terrorists were released from custody by the Biden administration and live in the U.S. pending hearings on their phony asylum claims? And that is not even counting the more than a million got-aways. This is an imminently dangerous national security crisis that is occurring solely because of President Biden’s reckless open border and catch-and-release policies.

In addition, multitudes of unvetted violent criminals have crossed the border illegally. The Biden administration has released many of them without regard to the safety of the American people. Consequently, these criminals are in cities and towns all over the United States murdering, raping, robbing, and assaulting innocent Americans. A tragic example is Linken Reilly, the Georgia nursing student who was murdered allegedly by an illegal immigrant who had crossed the border into Texas and was released under President Biden’s catch-and-release policy.

Mexican cartels have smuggled illegal immigrants across the southern border. The cartels have used street gang members, some of whom are affiliated with MS-13 and have entered the U.S. illegally, to do their dirty work in this country. The cartels have also smuggled fentanyl into the country. Fentanyl overdoses killed more than 100,000 Americans in 2023 alone.

Texas’s government has an obligation to its residents to protect their safety. Article I, Section 10 of the United States Constitution recognizes this duty of the states by authorizing them even to “engage in War” if they are “actually invaded, or in such imminent Danger as will not admit of delay.”

The Biden administration failed to carry out its responsibility under Article IV, Section 7 of the Constitution to “protect” each of the states “against Invasion.” The Lone Star State decided to act on its own, without any further delay, to deal with the imminent danger that its residents have been facing because President Biden has refused to faithfully execute America’s immigration laws.

Installing razor-wire fencing along the border is far short of engaging in war. It is a reasonable measure to deal with the imminent dangers posed by the border crisis that the Biden administration created. Even so, while the fencing has already proven to be a major success, dramatically reducing the flow of illegal immigrants into Texas, it alone is not the total answer. On March 21st, hundreds of illegal immigrants managed to force their way through razor wire, knocked down members of the National Guard trying to protect the border, and invaded the sovereign territory of the United States.

Nevertheless, razor-wire fencing is better than no barrier at all. Without the fencing, many, many more illegal immigrants would be able to continue freely pouring into the country. Texas is trying in good faith to solve the problem President Biden created. The Biden administration’s answer is to take Texas to court to obstruct Texas from protecting its own residents with a border barrier that will at least slow down the invasion.

As a complement to razor-wire fencing, Texas passed a law recently, which has not yet gone into effect, making it a state crime to cross the southern border into Texas illegally. This is another reasonable measure, far short of engaging in war, that is intended to compensate for the Biden administration’s total dereliction of duty. The law known as S. B. 4 authorizes Texas law enforcement officers to arrest these illegal immigrants, who could face jail time or deportation.

The Biden administration has challenged this state law in federal court. It claims that Texas is intruding on the exclusive authority of the federal government to set immigration policy and enforce the nation’s immigration laws as well as undermining the nation’s foreign policy.

So far, the case is in a procedural limbo. The Supreme Court got involved at this stage by first issuing and then lifting on March 19th a temporary administrative stay on the law taking effect. The Supreme Court then sent the case back to the Fifth Circuit Court of Appeals for further deliberation. What must be emphasized here is that the Supreme Court has not yet addressed the merits of the Biden administration’s lawsuit.

But alas, Texas’s enforcement of its border security law is on hold again, at least for the time being. The Fifth Circuit Court of Appeals decided to impose a temporary pause of its own. The purpose was to maintain the status quo as this Court considers whether to issue a longer stay that would stop S. B. 4 from being enforced while an appeal of the case on the merits is considered.

After all the dust settles, this case will most likely end up again at the Supreme Court. This time it would be to render a final decision on the merits of the Biden administration’s lawsuit. When that time comes, the Supreme Court will hopefully confirm Texas’s constitutional right to protect its own residents from the imminent danger unleashed by more hordes of illegal immigrants invading the country, especially suspected terrorists, violent criminals, and human and drug traffickers. President Biden’s open border and catch-and-release policies have caused this crisis. He and his administration must be ordered to stand aside and let the adults in the room take over.
