America First Legal wins case against Fairfax County Public Schools over boys in girls' bathrooms - Natalia Mittelstadt

AFL obtained judgment on behalf of a female student who was told that if she was uncomfortable with a boy in the girls’ bathroom, then she must use a different restroom

 

America First Legal has won a federal case against Fairfax County Public Schools over boys being allowed to use girls' bathrooms.

The nonprofit law firm announced Tuesday that it obtained judgment Friday on behalf of a female student who was told that if she was uncomfortable with a boy in the girls’ bathroom, then she must use a different restroom. The school board, after failing to get the case dismissed, offering judgment, awarding nominal damages to AFL’s client and paying costs and attorneys’ fees.

The female student is a practicing Roman Catholic whom AFL alleged was being forced to comply with county policies that violated her religious beliefs and constitutional rights.

Fairfax County Regulation 2603 requires all students to use “preferred pronouns” for gender-expansive or transgender classmates, and allows biological males to access girls’ restrooms and locker rooms by claiming gender identity.

“Our client’s rights were violated, and today she has justice," AFL President Gene Hamilton said. "This judgment is a crucial reminder that no one is above the law. Fairfax County attempted repeatedly to block this case, and they failed. America First Legal will not stop defending students whose safety and dignity are threatened.”
